加拿大技术移民导引

就中文媒体而言,加拿大技术移民不是一个陌生的概念。但用中文撰写的加拿大移民法律的文章却少之又少。唐林律师行在实践之余,认为有必要向读者特别是关心去加拿大出国的读者从法律的角度解析技术移民加拿大的法律依据。鉴于澳大利亚是唐林律师行的最初注册地,以澳大利亚技术移民法律为参照系,以使读者有个比较,既在所难免又势在必然。

加拿大技术移民从适用对象概念上比澳大利亚定义得精确。简言之,只有被称为是技术工作者的人方有机会技术移民加拿大。该定义又分为两部分。一是联邦技术工作者,二是魁北克技术工作者。本文集中探讨所谓联邦技术工作者的移民法律,魁北克的因其特殊性须专门撰文介绍。

联邦技术工作者有三重含义组成。一是技术工作者;二是可能依靠自己能力在加拿大经济上自立,并以此作为成为永久居民的基础。三是成为永久居民后拟住在魁北克省之外的任何一个省。

就像澳大利亚技术移民有唐林律师行总结的四大基本条件一样,一个外国人,要技术移民加拿大,需满足一项基本条件。满足了这一基本条件,才可以进入打分,否则申请可不予以继续考虑而遭拒绝。这和澳大利亚不满足四大基本条件无法进行打分有异曲同工之妙。只是相比之下,加拿大的基本条件要容易实现的多。这一基本条件有一项要求、两项补充组成。一项要求是:在递交永久居民申请前的十年内,曾连续全时工作一年,或连续非全时工作但工作量等同于一年的连续全时工作,前提是所从事的一种或多于一种的职业是全国职业分类矩阵中特定的几类职业,但必须不是限制性职业。目前没有限制性职业。两项补充为:(一)在上述工作期间,所从事职业的工作须与全国职业分类中对该职业描述的导语一致;(二)在上述工作期间,所从事职业的工作职责与全国职业分类对该职业的工作职责的描述大多数一致,并从事所有该职业不可或缺的工作职责。满足了这一基本条件,一个外国人就被认为是技术工作者。唐林律师行发现,与澳大利亚必须先进行技术职业评估不同,加拿大没有职业评估要求。

一个外国人成为了技术工作者,就可以依照选择条件进入打分程序。可供打分的项目共有下列六项,分别为:教育程度、加拿大官方语言水平、工作经验、年龄、事先安排的雇用、适应性。除非能获得事先安排的雇佣分,申请人还需要具有法律固定的足够的资金,并且这一资金能带往加拿大去。

下面讲一下如何打分。

一、 教育程度(最高可打25分)
1、 高中毕业:5分;
2、 高中毕业后非大学的一年学历,使总共全时在学时间不低于12年:12分;
3、 高中毕业后非大学的一年学历,使总共全时在学时间不低于13年,或者大学本科一年学历,使总共全时在学时间不低于13年:15分;
4、 高中毕业后非大学的两年学历,使总共全时在学时间不低于14年,或者大学本科两年学历,使总共全时在学时间不低于14年:20分;
5、 高中毕业后非大学的三年学历,使总共全时在学时间不低于15年,或者大学本科三年学历,使总共全时在学时间不低于15年:22分;
6、 大学硕士或博士学历,使总共全时在学时间不低于17年:25分。

加分原则是单项加分,不能重叠。满足多项,以最高分项计分。

如有等同学历,但不满足全时在学时间的年数,计分不变。

澳大利亚则有提名职业概念,按职业分为40分、50分、60分。40分以大专学历为主,50分以学士学位为主,60分则或者为专业人士或者为技术工人。并且,唐林律师行通过比较得出,加拿大没有澳大利亚特有的紧缺职业概念,当然也没有因为是紧缺职业而多获加分。

二、 英语和法语水平
加拿大官方语言为英语或法语。申请人如选择英语为第一官方语言,法语则为第二官方语言。反之英语则为第二官方语言。申请人通常需提供英语或法语指定考试成绩,不然需提供书面陈述来说明其英语或法语水平。最高可获打24分。依照《加拿大语言等级2000》来划分英语水平和《加拿大法语言标准2002》来划分法语水平。具体打分规则如下。

1、 第一官方语言听说读写任一项达到八级水平或以上的,获4分;第二官方语言听说读写任一项达到八级水平或以上的,获2分;
2、 第一官方语言听说读写任一项达到六级水平或七级水平的,获2分;第二官方语言听说读写任一项达到六级水平或七级水平的,获2分;
3、 任一项官方语言听说读写任一项达到四级水平或五级水平的,获1分,最高一项语言水平或2分。
4、 任一项官方语言听说读写任一项达到三级水平或以下的,获0分。

以雅思成绩为例,听说读写某单项达7.0,则该单项达到8级;听说读写某单项达5.0至6.9,则该单项达到6级或7级;听说读写某单项达4.0至4.9,则该单项达到4级或5级;听说读写某单项达4.0或4.0以下的,则该单项为3级或3级以下。

相比之下,唐林律师行认为,澳大利亚的语言水平就分四个六、四个五,其中四个五十四大基本条件之一。没有第二官方语言,要简单很多。

另外,澳大利亚移民法不对雅思的类别作区分,而加拿大移民法只接受通用(General)G类雅思作为英语水平的一种结论性证据。

三、 工作经验(最高可打21分)
澳大利亚对工作经验的限制很多,比如提名职业为60分的,必须18个月中有12个的雇用经验,此为基本条件。如想获得因雇用3年而获得工作经验分,则此3年必须是在递交申请前4年中积累的。相比之下,唐林律师行发现,加拿大的经验分,只要是过去十年内积累的就可以。前提当然还必须是所从事的职业(可以多于一个)全国职业分类矩阵中特定的几类职业,又必须不是限制性职业。可幸的是,目前没有限制性职业。具体打分要求为,全时工作一年15分;全时工作两年17分;全时工作三年19分,全时工作四年或四年以上的,21分。上述的两项补充继续适用。澳大利亚的雇用要求只为一周至少20小时,加拿大则要求一周工作至少37.5小时才算全时工作经验。

四、 年龄
唐林律师行认为,如果说加拿大的技术工作者移民和澳大利亚普通技术移民有差别的话,最大的差别莫过于对年龄的打分了。加拿大的年龄打分为:21岁至49岁,10分;20岁或50岁,8分;19岁或51岁,6分;18岁或52岁,4分;17岁或53岁;2分;17岁以下(不含17岁)或54岁及54岁以上,0分。而澳大利亚满了45岁就不满足四大基本条件之一从而无法移民。40岁至44岁为15分,之下每降5岁多5分,最高为29岁或29岁以下,为满分30分。

五、 事先安排的雇用(10分)
事先安排的雇用分为四种不同情况,满足任一情况即可获得10分,前提还是所从事的职业(可以多于一个)全国职业分类矩阵中特定的几类职业,并且能够从事被雇职业、有可能接受和从事该被雇用的职业,但却没有不是限制性职业的要求。这四种情况分别介绍如下。

1、 人在加拿大并持有工作准证并且
a) 移民官认为此人从事该职业对加拿大的劳工市场可能形成正面或中性的效应;
b) 此人现正从事着该职业的工作;
c) 工作准证在递申请时及对申请作决定时都有效;以及
d) 雇主对此人提供了一个针对此人不久就要获得永久居民为前提的不确定工作要约。

2、 人在加拿大并持有因如下理由之一而获得的工作准证:
a) 加拿大和另一国或多国的国际性协议,但不包含季节性农业劳工方面的协议;或
b) 此人所从事的工作对加拿大的公民或永久居民会创造或维持不可忽略的社会、文化或经济利益或机会;或
c) 被移民部长指定的因工作与研究、教育或培训项目有关的外国人可以从事的工作。
前提是此人现正从事着该职业的工作和雇主对此人提供了一个针对此人不久就要获得永久居民为前提的不确定工作要约。

3、 此人在获得永久居民前并无意向在加拿大工作并不持有工作准证,并且
a) 雇主对此人提供了一个针对此人不久就要获得永久居民为前提的不确定工作要约;以及
b) 在该雇主的要求下,加拿大人力资源发展部出具意见,认为
i. 雇用要约是真实的;
ii. 雇用不是非全时雇用也不是季节性雇用;以及
iii. 工资标准与加拿大通行的标准一致。
同时移民官基于该意见同意该雇用要约。

4、 此人持有工作准证,同时
a) 上述五1a)至五1d)以及五2都不适用;但
b) 五3a)和五3b)适用。

而在澳大利亚,就唐林律师行看,只有提名职业在紧缺技术职业(如上所说,这是加拿大没有的概念)清单上,有工作要约才能多加五分,而且还必须是雇用十人以上的公司或个人提供的要约。工作签证持有者与普通技术移民的关系不直接。

六、 适应性(最高可打10分)
共有下列五项可获加分。

1、 配偶或普通法伴侣的教育程度

一同申请移民的配偶或普通法伴侣(同居关系)的教育程度。计算方法为如此:人为技术工作者,教育程度可获25分的(如上述定义,下同),获5分;20或22分的,获4分;12或15分的,获3分。澳大利亚则配偶需满足四大基本条件方可获得5分。

2、 先前在加拿大的学习

申请人或一同申请移民的配偶或普通法伴侣在17岁之后持有学习准证在加拿大的用于高中毕业后学习的学校内进行了两年全时学习无论是否学完某一课程,申请人可因此获得5分。相比之下,澳大利亚更注重在澳的学习。一如唐林律师行化了很大功夫参与、跟踪、辨析、解释的那样,在澳大利亚全时学习两年并获得学位或文凭,可以豁免工作经验。

3、 先前在加拿大的工作经验

持有工作准证在加拿大有一年的工作经验,申请人可因此获得5分。澳大利亚则没有这样慷慨。一如唐林律师行在以前的文章中指出的那样,只在奖励分的四项的一项中有相关的加分,即48月中在澳工作6个月,并且还必须是技术职业清单上的职业,可在不满足其他三项中的任一项的情况下获得5分。

4、 在加拿大的家庭关系

申请人可在两种情况下满足任一情况因家庭关系而获加5分,并最多加5分。

一是申请人或一同申请移民的配偶或普通法伴侣通过血缘、婚姻、普通法伴侣关系、领养关系有在加拿大居住的公民或永久居民并申请人或一同申请移民的配偶或普通法伴侣的:

 父亲或母亲;
 父亲或母亲的父亲或母亲,即祖父、祖母、外祖父、外祖母;
 孩子;
 孩子的孩子,即孙子、孙女、外孙子、外孙女;
 父亲或母亲的孩子,即兄、弟、姐、妹;
 父亲或母亲的父亲或母亲的孩子,不包含父亲或母亲,即叔、姑、舅、姨;或
 父亲或母亲的孩子的孩子,即堂兄弟姐妹和表兄弟姐妹。

二是不和申请人的一同申请的配偶或普通法伴侣是居住在加拿大的公民或永久居民。

唐林律师行愿在此对两个国家的技术移民体系中因亲戚而加分稍作分析。(一)加拿大只将家庭关系作为一个微不足道的加分因素,而澳大利亚则将有亲戚担保的划为另类,并设有低得多的通过分或不设通过分,前者如138和881签证,后者如139和882签证等。(二)加拿大的家庭关系概念宽泛,而澳大利亚的则将不同的亲戚关系就不同的签证做出区分,比如138签证的担保人限制在父母、孩子、兄弟姐妹和叔姑舅姨,而139签证的担保人则扩充至祖父、祖母、外祖父、外祖母和堂兄弟姐妹和表兄弟姐妹,而孙子、孙女、外孙子、外孙女似乎从来没被考虑过做担保人的资格。(三)唐林律师行曾呼吁澳移民部添加的澳公民或永久居民配偶做技术移民担保人的动议至今未被采纳,即在澳普通技术移民体系中,已经是公民或永久居民的配偶反而不是亲戚,从而不能担保也不能加分,加拿大却将配偶与其他亲戚等同考虑。(四)澳大利亚的签证体系虽然严谨,但正如澳联邦法院大法官Moore指出的那样,过于复杂。比之于加拿大,唐林律师行认为有些复杂到了没必要的程度。

5、 具有事先安排的雇用(可加5分)。

以上为加拿大技术移民的导引,并就澳大利亚的同类项作了简单的比较。目前的通过分为67分。唐林律师行建议,凡自己打分等同或超过这一分的读者就可以认真考虑移民加拿大,前提是所从事的工作在下列的职业清单上。只是切记,澳大利亚正常的海外申请受理时间为一年,因调查等可能延搁一些时间,但超过一年半的很少很少。而加拿大的海外申请,在北京,45个月算快的,超过53个月的也有;在香港,则为38个月至59个月正常;在新加坡,则33至46个月为正常;台北相对短很多,正常为14至18个月。
